JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Andhramath P.S. Case No. 108 of 2021 instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 16.09.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 108 litres of liquor from a sack alleged to be carried by the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case, he was a

Patna High Court CR. MISC. No.2661 of 2022(2) dt.04-03-2022 2/2 passerby, the real culprits on seeing the police had thrown the sack and the petitioner came to be implicated when search was made.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with Andhramath P.S. Case No. 108 of 2021.
