ANJANA MISHRA ORAL ORDER 08-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is in custody since 25.01.2015 in connection with Barh P.S. Case No.350/2008 for the offences punishable under Sections 147, 148, 149, 302, 120(B) of the Indian Penal Code and under Section 27 of the Arms Act. Learned counsel for the petitioner submits that though this is a case under Section 302 of the Indian Penal Code but so far as the present petitioner is concerned, no specific act has been attributed against him in the alleged occurrence. He further submits that other similarly situated co-accused namely Viveka Nand Singh @ Viveka Pahalwan, whose name has figured in the F.I.R, has been extended the privilege of regular bail by this
Patna High Court Cr.Misc. No.3677 of 2016 (2) dt.08-02-2016 Court in Crl. Misc. No. 41738/2009 vide order dated 22.01.2010. It is also submitted that another similarly situated co-accused namely Abhay Kumar Singh @ Abhay Singh has been extended the privilege of bail by this Court in Crl. Misc. No.22957/2012 vide order dated 26.06.2012.
Considering the aforementioned facts and circumstances of the case and also that the other similarly co-accused have been extended the privilege of bail, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Barh, Patna in connection with Barh P.S. Case No.350/2008.
