Patna High Court MJC No.57 of 2023(4) dt.04-01-2024 2/2 04-01-2024 The present MJC (contempt petition) is filed for non-compliance of order passed in L.P.A. No. 98 of 2004 dated 28.03.2010, in the year 2023.

There is highly belated latches on the part of the petitioner in filing the present M.J.C. (contempt petition) against the order dated 28.03.2010 passed in L.P.A. No.98 of 2004 in the year 2023 and it is in contrary to Section 20 of the Contempt of Courts Act, 1971. Co-ordinate Bench has passed a detailed order in the case of Dr. Rajesh Kumar Sinha & Ors. Vs. The Union of India & Ors. bearing MJC No. 1840 of 2023 in C.W.J.C. No.13888 of 2016 in respect of maintainability of contempt petition. Hence, the present case is squarely covered by the aforementioned case.
