2. This is the third attempt of the petitioner for grant of regular bail.
3. Learned counsel for the petitioner submits that the petitioner was granted bail by this Court vide order dated 1.10.2024 passed in Cr. Misc. No. 65337 of 2024 but by mistake, it has been submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent though he was having criminal antecedent/s.
4. Learned counsel for the petitioner further submits that in the order dated 1.10.2024, a condition was imposed that the court below, before accepting the bail bonds of the petitioner will verify the antecedent of the petitioner and if it
Patna High Court CR. MISC. No.2543 of 2025(2) dt.05-02-2025 2/3 finds that the petitioner has criminal antecedent/s then his bail bonds should not be accepted. He further submits that the Court below verified the criminal antecedent of the petitioner and upon finding that the petitioner has criminal antecedent, his bail bonds were not accepted.
5. The recovery is of six grams of Smack from the petitioner and he is in custody since 8.5.2024.
6. Learned counsel for the petitioner also submits that the petitioner is ready to donate Rs. 25,000/- in some charitable organization without accepting his guilt.
7. Considering the facts and circumstances of the case and submissions of learned counsel for the petitioner, let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Sessions Judge, Muzaffarpur/concerned Court below in connection with Mithanpura P.S. Case No. 142 of 2024.
8. This is also subject to the condition that the petitioner shall deposit an amount of Rs. 25,000/- in Ramakrishna Mission Ashram, Bela, Muzaffarpur and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted after verifying the
Patna High Court CR. MISC. No.2543 of 2025(2) dt.05-02-2025 3/3 genuineness of the receipt produced by the petitioner.
9. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Mithanpura Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
10. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
