The petitioner apprehends his arrest in a case registered for the offence under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and Sections 66 (C), 66(D) of the I.T. Act.

It is alleged that this petitioner alongwith other accused persons are indulged in cheating innocent poor people. Petitioner has been made accused in this case on the basis of confessional statement of co-accused Nitish Chaudhary, who was apprehended on spot. It is further submitted that no incriminating article has been recovered from the possession of this petitioner. Rather, at the relevant time, he was working in Gujarat for his livelihood.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

No.2647 of 2023(4) dt.11-07-2023 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Giriyak (Katrisarai) P.S. Case No. 374 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
