JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is in custody since 25.12.2014 in Digha P.S. Case No.254/14 for the offence under Sefction 395 of the I.P.C.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that while the informant along with his associates reached near Ramji Chak, Digha after seeing fair of Dashahara festival from Patna City on 3.10.2014 at 4.30 A.M. 20-25 miscreants stopped them, assaulted them and snatched away their mobile phones, purse containing Rs.4200/-, A.T.M. card and helmates but none of them was identified.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.9692 of 2015 (5) dt.29-07-2015 2/2 he is in custody since 25.12.2014 and charge sheet has already been submitted in this case. The petitioner is not named in the F.I.R.. Nothing has been recovered from his possession. He has no criminal antecedent.

On behalf of the State it has been submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri Satya Priya Anand, J.M. Ist Class, Patna, in Digha P.S.Case No.254/14.
