JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to informant, the deceased left his home in the company of petitioner and two others and subsequently, his dead body was recovered near a bridge. The informant has admitted in her fardbyan that the petitioner was friend of the deceased and furthermore, the deceased had land dispute with FIR named accused, Parma Singh and Krishna Singh.
Learned counsel for the petitioner submits that the learned Additional Sessions Judge has referred several paragraphs of the case diary in the impugned order but in all the aforesaid
Patna High Court Cr.Misc. No.3051 of 2016 (2) dt.02-02-2016 2/2 paragraphs, the witnesses have repeated the statement of informant and, therefore, even if, the accusation levelled against the petitioner assumed to be true, then also, it is a case of last seen only.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Maner P.S. Case No. 283 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur.
