Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offence alleged under sections 457, 380 and 411 of the Indian Penal Code.

As per allegation, some anti-social elements committed theft in the house of the informant and took away articles and ornaments described in the F.I.R.

Learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot and nothing was recovered from his conscious possession and co-accused Bhola Sah from whose

Patna High Court CR. MISC. No.2791 of 2022(3) dt.31-05-2022 2/2 possession ornaments were recovered has been granted bail vide order dated 7.12.2021 in Cr. Misc. no. 55858 of 2021. He has submitted further that the petitioner is incarcerating since 21.7.2021 merely on the basis of criminal antecedents.

Considering the period of custody of the petitioner, let the petitioner above named be released on bail only after framing of the charge on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case no. 218 of 2021.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) s.hassan/- U T
