The petitioner, being the husband of the victim is languishing in jail since 02.12.2014 in a case registered for the offences punishable under Sections 304(B)/201/34 of the Indian Penal Code The accusation is of killing the daughter of the informant within two months of marriage for non-fulfillment of the dowry demand.
It is submitted by the learned counsel for the petitioner that on completion of the investigation the charge sheet has been submitted under Section 306/201 of the Indian Penal Code and the informant has subsequently retracted from his initial version and filed a petition to that effect before the court below.
Patna High Court Cr.Misc. No.8233 of 2015 (2) dt.04-03-2015 2/2 Considering the facts that the police has submitted the charge sheet under section 306/201 of the Indian Penal Code, let the above named petitioner be released on bail, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Ayar P.S. Case No. 77 of 2014. Learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions.
