JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-06-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bettiah Town P.S.Case No. 532 of 2014 registered for the offences punishable under Sections 413, 414, 420, 419, 467, 468, 471 of the Indian Penal Code.

Originally, petitioners were made accused in Chanpatia P.S.Case No.214 of 2014 on the ground that they had kept stolen vehicle but in course of investigation, it was found that the vehicle of the petitioners had been purchased from R.C.Enterprises, Motihari and on the aforesaid ground petitioners were granted privilege of anticipatory bail by a co-ordinate Bench of this Court

Patna High Court Cr.Misc. No.10092 of 2015 (4) dt.23-06-2015 2/2 vide order dated 17.12.2014 passed in Cr. Misc. No. 44790 of 2014 in Chanpatia P.S.Case No.214 of 2014 but subsequently the documents of seized vehicle of Chanpatia P.S.Case No.214 of 2014 were sent for verification and then it was detected that the documents of seized vehicle of the aforesaid case were forged and fabricated.

Learned counsel for the petitioners submits that documents of the vehicle of the petitioners were never sent for verification which is evident from perusal of list enclosed with the first information report.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah West Champaran in Bettiah Town P.S.Case No. 532 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
