ANSHUMAN ORAL ORDER 08-05-2025 Heard Learned Counsel for the petitioner, Learned Counsel for the Informant, who appeared in this case after receiving notice, and Learned APP for the State.
2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Mushari P.S. Case No. 138 of 2024, lodged on 25.05.2024, under Sections 341/323/313/376/504/506/34 of the Indian Penal Code.
3. Learned Counsel for the petitioner and learned Counsel for the Informant jointly prayed that both are residing
Patna High Court CR. MISC. No.1471 of 2025(4) dt.08-05-2025 2/2 together. As per the FIR, the informant is aged about 19 years and both Counsel submit that they are living together and leading a happy conjugal life. As such, Counsel for the Informant has no objection in granting bail to the petitioner.
4. Learned Counsel for the State submits that if husband and wife are ready then a sympathetical view may be taken into consideration.
5. In this view of the matter, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Exclusive Special Judge, POCSO Court No.03, Muzaffarpur, in connection with Mushari P.S. Case No. 138 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
