The petitioner has prayed for regular bail in a case instituted for the offence under Sections 363, 366(A) and 34 of the Indian Penal Code.

The allegation against the petitioner along with others is of kidnapping the daughter of the informant, when she went outside to attend nature call.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that the victim girl has

No.2890 of 2023(3) dt.04-05-2023 2/3 recovered and her statement has recorded u/s 164 of the Cr.P.C., in which she stated that petitioner and others co-accused had kidnapped and made her unconscious. When she regain conscious, she found herself at Delhi, from there Birendra Singh brought to Darbhanga, she was confined for 4 days and also assaulted by them. The victim girl does not whispered about the commission of physical abuse/misbehave with her. Moreover, petitioner has got no criminal antecedent as stated in para-3 the bail petition. He is languishing in judicial custody since 30.08.2022.

The application for bail is opposed by learned APP for the State and submitted that petitioner along with others coaccused taken her to Delhi after getting her unconscious, thereafter brought her to Darbhanga and the accused persons left her at the house of Mukhiya Ji of the village. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief
