This application is for grant of regular bail in connection with Gogri P.S.case No.303/19, G.r.No.2714 of 2019 for the offences under Sections 304/B/34 of the Indian Penal Code.

Petitioner happens to be husband. Case is of dowry death with allegation of demand and for that torturing her and the postmortem report shows that the cause of death is strangulation.

Submission of the learned counsel for the petitioner is that petitioner had informed to the family members of the deceased that she has committed suicide but the petitioner has falsely been implicated in this case and he is in

Patna High Court CR. MISC. No.831 of 2020(3) dt.20-02-2020 2/2 custody since 11.9.2019.

However, the learned counsel for the informant has opposed the prayer for bail stating that the statement of the witnesses discloses the allegation of demand and torture and the FIR further discloses that the deceased had informed the informant about the assault and later on dead body was found. There is a finding in the postmortem report of strangulation. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner .

With the aforesaid observation, this application is dismissed.
