Learned counsel for the petitioner is directed to remove the defect (s), as pointed out by the office, within a period of four weeks.

Explanation/counter affidavits have been filed on behalf of the District Magistrate and the Superintendent of Police, Aurangabad and the same is accepted.

Earlier bail applications of the petitioner were rejected vide Cr. Misc. No. 31521 of 2019 under order dated 24.09.2019 and Cr. Misc. No. 28374 of 2020 under order dated 03.02.2021, annexed as Annexure-1 series to the present application taking into account that the petitioner is the assailant. This is third attempt on behalf of the petitioner for

Patna High Court CR. MISC. No.2768 of 2022(5) dt.24-08-2022 2/2 grant of bail.

A report was called for from the court below regarding the present stage of the case. It has been reported that the case has been fixed for judgment.

Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected in Madanpur P.S. Case No. 190/2018, pending in the court of learned A.D.J.-III, Aurangabad. (Sudhir Singh, J) U.K./- U T
