JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is case and counter case between the parties and persons from both the sides sustained injury. The reason behind the alleged occurrence is said to be flow of water of hand pipes towards the field of injured of this case. Moreover, after investigation, in both the cases, police submitted charge sheet. So far as injured is concerned, the informant's father has sustained one grievous injury on his finger said to be caused by this petitioner. The opinion regarding the injury of informant was kept reserved and it appears that the opinion was not obtained by the investigating officer even at the time of submission of the charge sheet.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.12460 of 2015 (2) dt.27-03-2015 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bhagalpur in connection with Sajour (Sahkund) P.S. Case No. 183 of 2014.
