JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Warisnagar P.S. Case No. 247 of 2019 registered for the offences punishable under Sections 420, 409, 406 and 506/34 of the Indian Penal Code.

As per FIR petitioner being Manager of Hans PACS misappropriated an amount of Rs.26,46,196/- along with other persons and the same was detected in Audit and when legal notice was given to him he threatened the informant on the point of pistol.

Submission of learned counsel for the petitioner is that whole allegation is false as petitioner is entitled to keep upto Rs.1000/- with him and distribution is made under the guidelines of the Co-operative Bank.

Heard learned APP and learned counsel for the

Patna High Court CR. MISC. No.2112 of 2020(2) dt.24-01-2020 2/2 informant, who has opposed the prayer for anticipatory bail on the ground that Audit report disclosed that main allegation is against the petitioner and others and even legal notice was given to deposit the amount he disobeyed the notice. In view of allegation as stated above, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail, which shall be considered by the court below on the basis of materials collected during investigation.

This application is, accordingly, dismissed.
