The petitioner seeks bail in connection with Nokha P.S. Case No. 167 of 2022 instituted for the offence under Section 394 of the Indian Penal Code.

As per prosecution case, four unknown miscreants entered into the 'Bandhan Bank' with arms and took away cash to the tune of Rs. 1,94,710/-, three mobile phones, three tablets and a laptop on the point of pistol.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15-04-2023. Petitioner bears ten criminal antecedents, as per disclosure made in

Patna High Court CR. MISC. No.5585 of 2024(2) dt.12-02-2024 2/3 paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the F.I.R. Name of the petitioner has surfaced in this case due to confessional statement of coaccused, namely, Ajay Kumar, who has been granted bail by Co-ordinate Bench of this Court vide order dated 12-07-2023 passed in Cr. Misc. No. 39596 of 2023. Other co-accused have been granted bail by Co-ordinate Bench of this Co-ordinate Bench of this Court passed in Cr. Misc. No. 54547 of 2023 & Cr. Misc. No. 31178 of 2023. It is also submitted that nothing incriminating articles have been recovered from the possession of the petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nokha P.S.
