JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 10-052015 in a case registered under Section-366A of the Indian Penal Code.

The victim has already returned and her statement u/S 164 of the Cr.P.C. was recorded. The victim stated that the petitioner administered some intoxicated substance and forcibly, took her by a tempo but she has, nowhere, stated as to how she got released herself from the clutches of the petitioner and the aforesaid fact has not been investigated by the investigating officer.

Learned counsel, appearing for petitioner submits that

Considering the above-said facts and circumstances of the case as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Buddha Colony P.S. Case No. 113 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Patna.
