ANJANA MISHRA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being an old man of eighty years is in custody since 23.11.2015 in connection with a case registered the offences punishable under Sections 420/467/468/471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he had caused a forged order to be prepared in his favour in Mutation Appeal Case. The said order was subsequently challenged. He submits that the petitioner has not availed benefit of any such forged order and, therefore, criminal liability cannot be saddled on his shoulder. Considering the nature of allegations made and that such forged and false orders can well be repudiate in a Court of competent jurisdiction and also the period of custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S.
