This application for anticipatory bail arises out of Maker P.S. Case No. 175 of 2021 for the offence punishable under Sections 341, 323, 353, 343 of the India Penal Code 1860 and under Section 30, 30 (A), 37 (b) (c) of Bihar Prohibition of Excise Act, 2016.

In view of the fact that recovery is not from the conscious possession of the petitioner and there is only recovery of 1.125 M. L., this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge Excise, Saran, subject
