JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 The petitioner seeks regular bail in connection with Sonepur P.S. Case No. 844 of 2019, registered for offences punishable under Sections 420, 509, 120(B) of the Indian Penal Code and Sections 66, 67, 67 (C) of the I.T. Act. Allegation against the petitioner is of uploading objectionable remark on the character of the informant and it is alleged that informant has dispute with his brother, as the informant is an eye witness in a case, in which, his brother is accused and informant has alleged that he has hired the petitioner to kill him.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the basis of suspicion and he has been in judicial custody since 02.12.2019.

Patna High Court CR. MISC. No.2850 of 2020(3) dt.25-02-2020 2/2 Heard learned A.P.P. as well as learned counsel for the informant. They have opposed the prayer for bail on the ground that petitioner is accused in four other cases of similar type. Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Sonepur P.S. Case No. 844 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
