25-03-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

2972.85 liters of foreign liquor has been recovered from an Anganbari Centre and this petitioner is alleged to have fled away from the place of recovery after seeing the police. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from the Anganbari Centre, which is an open place, and petitioner has no concern either with the said Centre or liquor. Petitioner is in custody since 31.10.2021. Investigation is complete.

Patna High Court CR. MISC. No.2802 of 2022(2) dt.25-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - II cum Special Judge, Excise, Samastipur in connection with Hasanpur P.S. Case No. 176 of 2021, P.T. No. 311 of 2021.
