1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Sugauli P.S. Case No. 483 of 2023 dated 08.11.2023 registered for the offence(s) punishable under Section(s) 399, 402 and 414 of the Indian Penal Code and Section 25(1-b)a/26/35 of Arms Act and Section 8/20(b)(ii)(C)/25 and 29 of N.D.P.S. Act

3. The main submissions advanced by the learned counsel for the petitioner are that the petitioner is a 20 years old person having fair and clean antecedent and he is a motorcycle mechanic by profession and he has been falsely implicated in the present matter and as per allegation, only one mobile phone is said to have been recovered from his possession and the alleged fire-arms and narcotic materials are said to have been

Patna High Court CR. MISC. No.11669 of 2024(2) dt.28-02-2024 2/2 recovered from the possession of the co-accused persons with whom the petitioner has no any connection. Further submissions are that the petitioner has been languishing in jail since 09.11.2023 and against him, the investigation has been completed and the seized mobile phone belongs to the petitioner.

4. Learned APP appearing for the State opposes the bail prayer of the petitioner.

In the facts and circumstances of the case and considering the above submissions and also mainly the nature of allegation appearing against this petitioner and his fair and clean antecedent and coupled with the completion of investigation against him, this court is inclined to accept his bail prayer. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sugauli P.S. Case No. 483 of 2023 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
