The petitioner seeks bail in Paroo P.S. Case No. 218/12 registered for the offence under Section 302 and other sections of the Indian Penal Code.

The informant Rajnish Kumar named Rajendra Singh @ Bhola Singh and others and alleged that the accused persons along with other 15-16 persons came and discriminately assaulted his father, mother, brother and sister-in-law in which father, mother and sister-in-law of the informant died. The learned counsel for the petitioner submits that the petitioner is not named in the FIR. The name of the petitioner figured in confessional statement of co-accused Ravindra Singh. The petitioner was apprehended and he is in jail since 18.04.2013.

Patna High Court Cr.Misc. No.8753 of 2015 (2) dt.26-03-2015 2/2 The co-accused namely, Sonelal Sah and Vinod Sahani have already been enlarged on bail vide order passed in Cr. Misc. Case No. 17007/2014 and 48797/2014.

Considering the facts that except confessional statement, the police did not collect any further evidence nor put the petitioner on Test Identification Parade and submitted chargesheet, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Smt. Rashmi, Learned Judicial Magistrate, Muzaffarpur in connection with Paroo P.S. Case No. 218/12.
