2. Heard learned counsel for the petitioner and learned APP for the State.

3. Petitioner seeks regular bail for the offence punishable under Sections 399, 402 of the Indian Penal Code and Section-25(1-b)a/26/35 of the Arms Act.

4. As per allegation, one country made pistol as well as 24 live cartridges, one knife, two mobile phones were recovered from co-accused Ram Niwas Yadav.

5. Learned counsel for the petitioner submits that petitioner is innocent and he has been falsely implicated in this case. He further submits that there is no recovery from the

Patna High Court CR. MISC. No.6509 of 2025(2) dt.31-01-2025 2/2 conscious possession of the petitioner and the name of the petitioner has transpired on the basis of the confessional statement of the other co-accused person. Petitioner has got two criminal antecedents as stated in para-3 of the petition. The petitioner is in custody since 23.10.2024.

6. Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid circumstances as well as fact that the name of the petitioner has transpired on the basis of the confessional statement of the other co-accused persons, so I am inclined to grant bail to the petitioner. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousands) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Manihari P.S.
