The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 32, 36 and 41(1) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, the petitioner was taken into custody and 160.48 litres of liquor was recovered from his vehicle.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession or his vehicle. He has been falsely implicated in the case. He is in custody since 19.11.2021. It is categorical assertion of learned counsel for the petitioner that charge sheet has been submitted in the case. The petitioner has no criminal

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, including the charge sheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Special Case no. 7554 of 2021 (arising out of Danapur P.S. Case no. 826 of 2021) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna.
