Petitioner seeks bail in a case registered under Sections 302/34 IPC.
The informant alleged that the petitioner came after drinking wine and started abusing him. On protest by his son-inlaw, Mahesh Rai, the petitioner along with co-accused Niranjan Pandit and Shiv Ranjan Pandit assaulted Mahesh Rai with stick, who died.
It is submitted that three persons are alleged to have assaulted Mahesh Rai but the police, who prepared the inquest report, did not find any injury on the body of the deceased. The Post Mortem Report shows that the deceased got one injury on right temporal region 2"x2". Three persons are alleged to have assaulted but only one injury was found. The petitioner is in jail since 12.4.2014, i.e. for about 11 months.
Considering the facts aforesaid, the petitioner, named
Patna High Court Cr.Misc. No.4567 of 2015 (3) dt.11-03-2015 above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Ad hoc Additional Sessions Judge, VI, Patna in connection with Sessions Trial No.799 of 2014 arising out of Kadamkuan (Patrakar Nagar) P.S.Case No.301 of 2004.
