JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2016 Heard the learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner seeks bail in connection with Tarapur P.S. Case No. 133 of 2015 registered for the offence punishable under Section 379 of the Indian Penal Code.

Allegedly, the petitioner snatched bag containing cash amounting Rs.1,50,000/- and started fleeing away but was caught by the informant and in the meantime, the petitioner handed over the bag to another boy and in that process two bundles of notes of 500/- denomination fell down. However, another boy succeeded in fleeing away and the petitioner disclosed his name as Manikant Kumar.

Submission is of false implication and that the

No.2912 of 2016 (3) dt.15-03-2016 2/3 petitioner has been made victim of the circumstances, nothing has been recovered from the conscious possession of the petitioner, the seizure list does not show the alleged amount which were fallen down and without any tangible material, the petitioner is suffering in custody since 29.10.2015. The learned A.P.P. opposes the prayer of bail by submitting that the petitioner has got criminal antecedent also. In the facts and circumstances stated above, considering detention of the petitioner, above named, now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Munger in connection with Tarapur P.S. Case No.

133 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
