2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a), 44 ( b ) of Bihar Prohibition and Excise (Amendment ) Act 2022 . 3 . As per prosecution case , 35 liters country made liquor was recovered from plastic bag.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal antecedent of similar nature in which he is on bail. 5 . Learned counsel for the State opposed the bail

Considering the facts of the case , in the event of arrest/surrender within eight weeks from today , let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge , Excise First Begusarai in connection with Muffasil Police Station Case No. 354 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
