Petitioner seeks bail in a case under Section 302 and other sections of the IPC.
The informant found the dead body of his brother and alleged that he suspects that Manoj Kumar, Arvind Kumar, Arun Kumar and Dheeraj Kumar might have killed his brother. It is submitted that Manoj Kumar and Dheeraj Kumar have already been enlarged on bail vide order dated 4.2.2015 passed in Cr.Misc.No.63638 of 2014. There is no eye witness of the occurrence. It is alleged that a month ago, the petitioner is alleged to have tried to outrage the modesty of the sister of the deceased and for that Dulhin Bazar P.S.Case No.16 of 2014 was lodged. But that too, can be a circumstance and there is no eye witness of the occurrence.
Considering the facts that there is no eye witness of the occurrence and only suspicion is cast upon the petitioner and other co-accused persons have been enlarged on bail, the
Patna High Court Cr.Misc. No.9967 of 2015 (2) dt.13-03-2015 petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Danapur in connection with Dilhin Bazar P.S.Case No. 31 of 2014.
