2. The petitioner apprehends his arrest in connection with Amas P.S. Case No. 70 of 2023, registered for the offences punishable under Section 30(a) (d) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 60 litres of illicit desi mahua liquor, 2000 litres of Jawa mahua was recovered from a Morainlia forest.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. No incriminating materials has been recovered from the conscious possession of the petitioner. The alleged recovery is

5. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts of the case and also considering the clean antecedent of the petitioner, the prayer for anticipatory bail is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No.-V, Gaya, in connection with Amas P.S. Case No. 70 of 2023, subject to condition as laid down under Section 482 of the B.N.S.S.
