Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code in which charge-sheet has been submitted under Sections 304(B), 302/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 04.04.2021, charge-sheet has been submitted and is a person with clean antecedent and is the husband of the deceased.

On query of the Court, learned counsel for the

Patna High Court CR. MISC. No.2694 of 2022(2) dt.26-05-2022 2/2 petitioner very fairly submits that charges have been framed and trial has commenced and one witness has also been examined. Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the bail application. Permission is accorded with a direction to the learned court below to ensure that the trial is completed expeditiously preferably within a period of nine months from the date of receipt/production of a copy of this order.

Accordingly, this application is dismissed as withdrawn in connection with Salkhua P.S. Case No. 60 of 2021 pending in the Court of learned Additional Chief Judicial Magistrate-IV, Saharsa/successor Court.
