JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-09-2019 This is an application for grant of anticipatory bail in connection with K. Hat P. S. Case No. 173 of 2014, disclosing offences under Sections 420, 406, 467, 468 and 120B of IPC. Prosecution case is that complainant/informant got 53 decimal of land purchased from the husband of the petitioner and she erected the boundary wall over the same also, but thereafter, she came to know that the husband of the petitioner sold some portion of the land to the petitioner and as such, petitioner is making claim over the same. In this way, they have cheated the complainant/informant.
Submission of the learned counsel for the petitioner is that the land has been purchased by the petitioner from her husband and petitioner has not sold the land and as such, whatever the allegation is that is against her husband and not against this petitioner. Further submission is that she is a lady
Patna High Court CR. MISC. No.21745 of 2019(3) dt.13-09-2019 2/2 and she is ready to abide by any condition imposed upon her. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat P. S. Case No. 173 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with the condition that she has to co-operate in the investigation and appear as and when required.
