1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Mithanpura P.S. Case no.334 of 2023 registered under sections 413, 414 and 34 of the Indian Penal Code.

3. As per the prosecution case, on checking being conducted by the police personnel, it is stated that the petitioner and one another who were on a motorcycle were stopped. On being asked, they could not produce any document for the motorcycle. As such, the case.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. No incriminating article nor any motorcycle has been recovered from the petitioner's possession. He is in custody since 2.8.2023

5. Heard learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the petitioner being in custody for more than 5 months since 2.8.2023, chargesheet having been submitted in the case and specially the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Mithanpura P.S. Case no.334 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Court no.-6, Muzaffarpur (East), Muzaffarpur.
