JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 The petitioners apprehend their arrest in connection with Rauta P.S.Case No. 89 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation as per the FIR is that there is recovery of 750 ml wine from the possession of co-accused and he has disclosed the names of these petitioners. It further appears that petitioners are accused in one more case.

Submission of learned counsel for the petitioners is that nothing has been recovered from the possession of the petitioners and in other case, they are on bail. Heard learned APP also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners rather they should
