JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Purnahia P.S.Case No. 21 of 2014 registered for the offences punishable under sections 25(1-B)(a) and 26 of the Arms Act.

The prayer for bail of the petitioner was earlier rejected by this Court by order dated 9th September, 2014 passed in Cr.Misc. No. 29783 of 2014 with following observations :- "The learned judicial Magistrate-1st Class, Sheohar before whom the matter is pending, is directed to conclude the trial of the case as early as possible preferably within a period of six months from the date of receipt/production of a copy of this order, failing which the petitioner would be entitled to renew his prayer for bail."

Patna High Court Cr.Misc. No.15080 of 2015 (2) dt.15-04-2015 2/2 It has been contended that though the petitioner is in custody since 22nd April, 2014 but till date not even a single witness has been examined on behalf of the prosecution in course of trial.

Regard being had to the observations made in the aforesaid order dated 9th September, 2014 passed in Cr.Misc. No. 29783 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Subhash Chandra, learned Judicial Magistrate 1st Class, Sheohar in connection with Purnahia P.S.Case No. 21 of 2014.
