2. The petitioner seeks regular bail in a case registered for the offence under Sections 394, 302, 34 of the Indian Penal Code and U/s 27 of the Arms Act.

3. As per the prosecution case, informant was shot at and motorcycle was snatched.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the possession of the petitioner and the petitioner is in custody since 06.02.2023. He further submits that except the confessional statement of the co-accused, there is no material against the petitioner.

5. Learned A.P.P. has vehemently opposed the

Patna High Court CR. MISC. No.4164 of 2024(3) dt.09-04-2024 2/2 prayer for bail.

6. Considering the period of custody and the fact that no material has come against the petitioner, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Udakishunganj/concerned Court below in connection with Puraini P.S. Case No. 182 of 2022 subject to condition that:- 7(i). The petitioner will mark his attendance at the Puraini Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
