2. Petitioner seeks regular bail in connection with Bachhwara P.S. Case No. 325 of 2024 dated 01.09.2024 registered for the offences punishable under sections 115(2), 127(1), 74, 303(2), 352, 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS') and later on, section 109 of BNS was added.

3. As per prosecution story, the informant alleged that five named accused, including the petitioner, assaulted her son and petitioner assaulted him by using bricks and stones and also outraged her modesty. It is further alleged that the cause of alleged occurrence was road dispute.

4. Heard both the sides, perused the FIR.

In the facts and circumstances of this case and considering the averments made in the petition and mainly petitioner's the pleas that both the parties are agnates and admittedly, there is a land dispute in between them and on the body of the sole injured, three injuries were found, though one injury found at temporal region has been opined to be grievous in nature but the same is not specifically attributed to the petitioner and he is alleged to have assaulted the informant by means of bricks and stones and also coupled with petitioner's custody period and the completion of investigation against him, this Court is inclined to grant the relief of regular bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Bachhwara P.S. Case No. 325 of 2024.
