JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 24.04.2015 in a case registered for the offences punishable under Sections 20 and 22 of the NDPS.

From the possession of the petitioner, 50 bottles of corex syrup and 144 tablets of Sparmo proxyvon plus were recovered.

It is submitted by learned counsel for the petitioner that the impugned order reflects that the FSL report has still not been received, though, the investigation has already concluded and charges have already been framed. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

No.3103 of 2016 (2) dt.20-01-2016 2/2 concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Kishanganj in connection with Special Case No. 103 of 2015 arising out of Thakur Ganj P.S. Case No. 95 of 2015.

The trial court will be at liberty to cancel the bail bonds of the petitioner if he defaults for three consecutive occasions or gets involved in similar nature of offence.
