Petitioners are in jail custody since 27.2.2014 and 15.10.2014 respectively in a case registered under sections 366A, 120B of the Indian Penal Code.

Admittedly, victim was recovered from Raghunathpur railway station and she was found between 17 to 18 years by the Medical Board. The statement of victim girl was recorded under section 164 Cr.P.C in which she stated that she had gone to Ranisagar along with petitioner no.1 from where she went to Kolkata and thereafter she went to Dumrau.

Although victim stated that petitioners and some other accused committed rape on her but co-accused Madan Khan and Firoz Khan have already been granted privilege of bail by a coordinate

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Bagen Gola P.S. Case no. 12/2014.
