The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 365, 364, 120(B)/34 of the Indian Penal Code and later on added section 302 & 201 of the I.P.C.

Prosecution case, in brief, is that the informant alleged that the accused persons along with others abducted and have caused death of the son of the informant namely, Sanjeet Kumar. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Initially, the FIR has been lodged against unknown but subsequently the informant again submitted an application before concerned SHO

Patna High Court CR. MISC. No.3484 of 2023(3) dt.28-06-2023 2/2 and raised suspicion against the petitioner along with others who might be involved in the alleged occurrence, thereafter this petitioner has falsely been made an accused in the present case. The petitioner confessed her involvement in her self confessional statement before the police, which is inadmissible in the eye of law. The petitioner has got no criminal antecedent. Moreover, the petitioner is a lady and she is languishing in judicial custody since 6.9.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Baruraj P.S. Case No. 192 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, West, Muzaffarpur.
