JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seek pre-arrest bail in connection with Kesariya P.S. Case No.374 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 307, 353, 379, 504 and 506 of the Indian Penal Code.
Considering the allegation made in the first information report that the accused persons assaulted the informant Assistant Sub Inspector of Police, I am not inclined to grant pre-arrest bail to the petitioners, namely, Sonu Patel @ Sonu Kumar, Lalan Rai @ Lalan Patel and Chhedi Rai. Their application for grant of pre-arrest bail is
Patna High Court Cr.Misc. No.3538 of 2019(2) dt.25-01-2019 2/2 rejected.
As far as the petitioner no.4 Kalawati Devi is concerned, in the event of arrest or surrender before the court below, she is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., XI, Motihari in connection with Kesariya P.S. Case No.374 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
