The petitioner seeks bail in connection with Khodawandpur P.S. Case No. 58 of 2019 registered for the offences punishable under Sections 328, 302, 379/34 of the Indian Penal Code.
The petitioner has filed the present bail application renewing her prayer for bail after it was rejected earlier by order dated 04.12.2019 in Cr. Misc. No. 56416 of 2019 and thereafter by order dated 20.02.2021 in Cr. Misc. No. 34800 of 2020 as such this is the third attempt of the petitioner to pursue the bail. The learned counsel for the petitioner submits that the petitioner is in custody since 27.06.2019, charge-sheet has been submitted in the case and is a person with clean antecedent and
Patna High Court CR. MISC. No.3290 of 2022(2) dt.26-05-2022 2/2 is a woman and till date charges have not been framed nor the case has been committed. The learned counsel submits that petitioner has remained in custody for nearly three years. The learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that petitioner being a woman is in custody for the last nearly three years and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khodawandpur P.S. Case No. 58 of 2019.
