ANJANA MISHRA ORAL ORDER 27-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is custody since 19.07.2014 in connection with Daraunda (M.H. Nagar) P.S. Case No. 130/14 registered for the offences punishable under Sections 302, 307/34 and 447 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner's name has surfaced in connection with the present case on the basis of the confessional statement made by one Pankaj Kumar Pandey, who was arrested in a case under Section 379 of the Indian Penal Code. So far as this petitioner is concerned, his name has surfaced in connection with the present case only on the basis of confessional statement made by a co-accused before the Police and as such the petitioner has been roped into the present

Patna High Court Cr.Misc. No.13537 of 2015 (2) dt.27-05-2015 P2/2 case.

Considering the aforesaid submissions and also the fact that the petitioner has been in custody since 19.07.14 and is facing prosecution in connection with another case under Section 379, but save and except the said case, he has no other criminal antecedent, let the petitioner Murari Tiwari be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Siwan in connection with Daraunda (M.H. Nagar) Police Station Case No. 130/14.
