JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-10-2018 Heard Mr. Sunil Kumar Thakur, learned counsel for the petitioner and Mr. Apurva Kumar, learned AC to GA-04 for the respondent-State.

The present writ application has been filed for a direction to the respondent authorities to provide protection to the life and property of the petitioner, as private Respondent No.6, Gango Ram, has illegally encroached upon the land of the petitioner, appertaining to Khesra No.302, Khata No.23 and Khesra No.303, Khata No.01, situated in Mauza Dighra, Circle Pusa, District Samastipur.

After some argument, learned counsel for the

Patna High Court CWJC No.11207 of 2017(2) dt.01-10-2018 2/2 petitioner seeks permission to withdraw the present writ application with liberty to submit a representation before Respondent No.2, the District Magistrate, Samastipur and Superintendent of Police, Samastipur for getting protection. Permission is accorded.

If such representation is filed within a period of three weeks from the date of receipt/production of a copy of this order, then it is expected from the concerned respondent authorities to dispose of the same within a period of four weeks of its submission.

Accordingly, the present writ application is disposed of as withdrawn with liberty above-mentioned. The withdrawal of the present writ application will not preclude the petitioner to take recourse to appropriate remedy at appropriate forum.
