JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 119 of 2017, corresponding to Trial No. 1540 of 2018, in which cognizance has been taken under Section 498A IPC and 3/4 of Dowry Prohibition Act.
Case is under Section 498A IPC with respect to demand of Rs.1 lac for the purpose of business and for nonfulfilment of demand petitioner along with other accused persons assaulted the complainant.
On appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre by order dated 22.2.2019 and the Mediator's report at
Patna High Court CR. MISC. No.3444 of 2019(5) dt.08-07-2019 2/3 Flag 'M' shows that the parties are not interested in settling the matter through the process of mediation. However, learned counsel for the petitioner has submitted that the matter has been settled between the parties and now petitioner has taken opposite party No.2 with him and they are residing together. Heard learned APP and learned counsel for opposite party No.2, who has also admitted the aforesaid fact. In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.
25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Complaint Case No. 119 of 2017, corresponding to Trial No. 1540 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner along with opposite party No.2 shall appear before the court below on 5.9.2019 and if the opposite party No.
