2. The petitioner seeks bail in connection with Kishanganj P.S. Case No. 439 of 2024 registered for the offence under Sections 336(3), 338, 340(2), 318(4), 3(5) of the BNS.

3. From the allegations levelled in the FIR, it appears that the petitioner was appearing in a competitive examination in place of another candidate.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and he was himself the candidate of the said examination and no forgery has been committed by him and charge-sheet has been submitted in this case.

5. Learned counsel for the petitioner further submits that the petitioner has clean antecedent and he is in custody since 24.10.2024.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj/concerned Court below in connection with Kishanganj P.S. Case No. 439 of 2024.

8. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
