JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, petitioner is son of the deceased and the informant claimed that his daughter-in-law had seen the petitioner liting fire on the person of the deceased.
The contention on behalf of the petitioner is that there was previous enmity of land dispute between the informant and the petitioner and as a matter of fact, the deceased was killed by informant and his other family members and after the occurrence, the informant gave information to police but police, in collusion with the informant of the present case, lodged the present case against the petitioner and arrested him on 17-09-2014 and since then, he is languishing in jail custody.
Patna High Court Cr.Misc. No.12619 of 2015 (3) dt.08-09-2015 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/_ (ten thousand) with two sureties of the like amount each in connection with Biraul P.S.
