JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 The petitioner seeks regular bail in connection with Barauli P.S. Case No. 405 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 39.600 litres of liquor from the motorcycle and petitioner was arrested on spot. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the motorcycle from which alleged recovery was made does not belong to petitioner. Further submission is that he has no criminal antecedent and has been in judicial custody since 24.11.2019. Heard learned A.P.P. also.

Having heard both sides, in view of the above

Patna High Court CR. MISC. No.1306 of 2020(2) dt.16-01-2020 2/2 submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge -II-cum-Special Judge, Excise, Gopalganj, in connection with Barauli P.S. Case No. 405 of 2019.
