However, learned APP for the State is present. This is an application seeking quashing of the order dated 09.11.2012 passed by the learned SubDivisional Judicial Magistrate (East), Muzaffarpur in Mushari P.S. Case No. 95 of 2009 whereby cognizance has been taken under Section 7 of the Essential Commodities Act, 1955.
Since there is no appearance on behalf of the petitioner, this Court has no idea about the stage of the case.
However, at this stage, this Court would not

If the trial of the petitioner has not concluded and it is still at the stage of framing of charge, necessary application may, if so advised, be filed by the petitioner to seek his remedies available to him under law.
